This Privacy Policy describes how ToneKid, Inc. (“ToneKid”, “we”, “us”) collects, uses, and shares information when you use the ToneKid iOS application and related websites (collectively, the “Service”).

By using the Service, you agree to the practices described below. If you do not agree, please do not use the Service.

Information We Collect

Information you provide

• Account information — email address, password (hashed), and any name or profile details you supply.
• Your Gear — the guitars, amps, pedals, and multi-FX devices you add to your gear profile.
• Tone history — the songs you analyze and the presets we generate for you.
• Communications — messages you send to support, including their contents.

Information collected automatically

• Device information — device model, operating system version, language, and a non-identifiable installation ID.
• Usage data — the features you use, screens you view, and the dates and times of your sessions.
• Diagnostic data — crash reports and performance metrics.

Information from third parties

• Apple — when you subscribe through the App Store, Apple shares limited transaction information with us (subscription status, original transaction ID). Apple does not share your payment card details with us.

We do not collect or store audio recordings from your device. Song analysis runs against our catalog of pre-analyzed reference recordings.

How We Use Your Information

• Provide and operate the Service, including generating tone presets adapted to your gear.
• Manage your account, authenticate sign-ins, and process subscriptions.
• Improve the Service, including training and evaluating our models on aggregated, de-identified data.
• Communicate with you about updates, support, and important changes.
• Detect, prevent, and address fraud, abuse, or security incidents.
• Comply with legal obligations.

How We Share Your Information

We do not sell your personal information. We share information only in the following limited circumstances:

• Service providers — cloud hosting, analytics, error monitoring, and customer support tools that process information on our behalf under contract.
• Apple — as required to deliver and manage your subscription.
• Legal — when required by law, subpoena, or to protect rights, safety, or property.
• Business transfers — in connection with a merger, acquisition, or sale of assets, subject to confidentiality.

Data Retention

We retain account information while your account is active. If you delete your account, we delete or de-identify your personal information within 30 days, except where we are required to retain it for legal, accounting, or fraud-prevention purposes.

Your Rights

Depending on where you live, you may have rights to:

• Access the personal information we hold about you.
• Correct inaccurate information.
• Delete your information.
• Restrict or object to certain processing.
• Receive your data in a portable format.
• Opt out of analytics processing.

Security

We use industry-standard administrative, technical, and physical safeguards including encryption in transit (TLS), encryption at rest, restricted access, and routine security review. No system is perfectly secure, and we cannot guarantee absolute security.

Children's Privacy

ToneKid is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us and we will delete it.

International Users

ToneKid is operated from the United States. If you use the Service from outside the United States, you understand that your information may be transferred to and processed in the United States, where data protection laws may differ from those of your country.

Changes to This Policy

We may update this Policy. We will notify you of material changes via the Service or by email and update the “Effective date” above. Continued use of the Service after a change means you accept the revised Policy.
